1. GENERAL PROVISIONS

1.1. This user agreement (hereinafter - the Agreement) in accordance with Art. 633, 641 and ch. 63 of the Civil Code of Ukraine is a public contract (offer) and is addressed to an indefinite circle of persons regardless of status (individual, legal entity, individual entrepreneur) wishing to purchase goods in an online store located on the Internet at kashtankyiv.com.
1.2. Terms and Definitions
Unless otherwise provided by the provisions of this Agreement, the following terms have the following meanings:
Acceptance - full acceptance by the Visitor or Buyer of the terms of the Agreement
Visitor - any individual - Internet user accessing the kashtankyiv.com online store
Buyer - any person, regardless of status (individual, legal entity, individual - entrepreneur), who orders and pays kashtankyiv.com.
The product is a material object, allowed for free circulation on the territory of Ukraine in accordance with the current legislation of Ukraine, manufactured and presented for sale through the online store kashtankyiv.com
Registration is a procedure in which a Visitor or Customer by filling out the appropriate forms of an online store with the necessary information (personal data) for the possibility of ordering and paying for goods in the online store kashtankyiv.com
1.3. Registration at the online store kashtankyiv.com means that the Visitor / Buyer is familiar with this agreement, understands and accepts it completely and unconditionally.
1.4. This Agreement may be amended and / or supplemented by the Administration of the online store unilaterally without any special notice. The new Agreement comes into force after placing it on the website of the online store kashtankyiv.com.

2. ORDERING

2.1. For the purchase of goods in the online store, the buyer places an order using the appropriate interface located on the pages of the online store.
3.2. When placing an Order, the Buyer agrees to provide accurate and accurate information about itself, its contact details and details of its Order. The Seller guarantees that the information received from the Buyer will not be passed on to third parties, except as required by the current legislation of Ukraine.
2.3. The Buyer bears full responsibility for providing false information, which made it impossible for the Seller to properly fulfill its obligations to the Buyer.
2.4. When ordering goods at night or after hours, as well as on weekends or holidays, the order is considered to be received at 10:00 am of the next business day.
2.5. After placing the order on the website, the Buyer receives a message about the reservation made or ordering the products via SMS or to the email address provided during the ordering process. The buyer may receive notifications about the delivery of the order or its delivery from a company specializing in the delivery of goods.
2.6. The Buyer has the right to cancel the order at any time before it is sent to the Buyer, by notifying the online store manager by phone or e-mail.
2.7. The seller reserves the right to change, delete or place in the online store any information about goods and services. At the same time, the seller can change the prices of goods and services, as well as terminate the functioning of the online store or modify any section of it at its discretion and without prior notice.
2.8. In the absence of the goods specified on the website of the online store due to technical problems, as well as for other reasons beyond the control of the seller, the order is canceled and the Buyer is informed by sending him a notification.

3. RETURN ITEM OF ORDER.

3.1. Please note that perfumery-cosmetic products of good quality are not refundable in accordance with the List of goods of good quality that can not be exchanged (returned) by consumers (buyers), approved by Resolution of the Cabinet of Ministers of September 23, 1991 N 216.
3.2. Upon receipt of the Goods of inadequate quality, the Buyer has the right to demand the replacement of a non-quality Product with a quality one. The Seller, in case of substantiated claims on the quality of the Goods, satisfies the Buyer's requirement within ten days from the date of the Buyer’s written claim and electronic photographs depicting the shortcomings of the Goods to the email address i@kashtankyiv.com. Claims must be submitted no later than 14 days after receipt of the Order by the Buyer.
3.3. If the Buyer refuses the Goods of inadequate quality, the Seller compensates him for the sum of money paid for the Goods, including the amount of delivery of the goods.

4. RESPONSIBILITY OF THE PARTIES

4.1. Seller is not liable beyond the amounts received from Buyers as payment for and the goods and services provided.
4.2. The seller is not responsible for violation of the delivery time by a company specializing in the delivery of goods.
4.3. Seller is not responsible in case of force majeure.
4.4. The parties make maximum efforts to eliminate differences only through negotiations.

5. APPLICATION CONSIDERED COMPLETED:

a) at the time of actual transfer of the Goods to the Buyer or another person who was at the time of delivery to the address specified in the order and paid for the Goods upon delivery by the Seller’s courier;
b) at the time of transfer of the Goods to the Purchaser by the organization delivering the goods.
